On January 1st 2020, a series of ADU laws went into effect in California. These new laws were designed to assist and encourage homeowners when adding an ADU on their property. 


California Assembly Bill 68 is the cover legislation for five 2020 ADU laws. These laws were written to help homeowners bypass the many rules, regulations and requirements that local building departments too often use to block new ADU construction.



 

Here are the important provisions California Assembly Bills: #68, #670, #881 and California Senate Bills: #13, #1226:


  • No impact fees required for an ADU under 750 square feet.


  • Impact fees for an ADU larger than 750 square feet shall be proportional to the size of the ADU in relation to the primary dwelling.


  • An ADU and the primary dwelling can be built at the same time. 


  • Local planning and building departments must approve all ADU applications within 60 days of submission.


  • An ADU can be as large as 1,200 square feet.


  • No utility connection or hook-up fees.


  • Utilities and parking spaces can be shared with the primary residence.


  • Tandem parking is allowed. 


  • If off street parking is not available an ADU will be allowed if located within 1/2 mile of public transportation. 


  • An ADU may be rented separately from the primary residence  and to non-family members.
